JOB SUMMARY:

Purpose of consultancy

The general purpose of this consultancy is to support the Health Law and Ethics Unit in assisting Member States of the Western Pacific to strengthen legal frameworks towards achieving health in the Sustainable Development Goals. Specifically, the consultant will support the Health Law and Ethics Unit to contribute to individual country support requests for strengthening legal frameworks for health.

Background

The Western Pacific Regional Action Agenda on Strengthening Legal Frameworks for Health in the Sustainable Development was endorsed by Member States at the 69th session of the Regional Committee for the Western Pacific (RC69) in October 2020. The action agenda provides guidance to countries on prioritising action areas, improving processes, and enhancing capacities of stakeholders. Direct support to countries on the strengthening of legal frameworks for health is a key priority for the Health Law and Ethics Unit (HLE).

As part of these efforts, HLE is supporting countries to:

  • review and strengthen their legal frameworks for health emergencies and managing public health risks after they were found to be not fit for purpose during the COVID-19 pandemic;
  • review and strengthen legal frameworks to strengthen health system governance and support effective service delivery; and
  • consider options for use of legislation to address specific areas of priority such as enabling use of digital health technologies

Countries require technical support to develop modern and effective legal frameworks for health system priorities and navigate the law-making process. HLE is targeting technical support to countries with existing demand and those with outdated or under-developed legal frameworks.  From 2021 to 2023, HLE has provided assistance to several Pacific countries.  That support is expected to continue in 2024.

Deliverables

Specifically, the consultant will support the following activities:

  • Contribute to team efforts on the development of legislative options to enable use of digital health technologies in Tuvalu
  • Contribute to team efforts on the review of the Public Health Act in Tuvalu
  • Contribute to team efforts on the review and amendment of legislation in other member countries where this has been requested.
  • Build on previous work undertaken to support the review and amendment of legislation in member countries.
  • Support the development of tools and knowledge products for the use of member states

Output 1: Technical support to law reform action in Tuvalu

Deliverable 1.1: Preparation of background research to provide analysis and reform options to enable use of digital technologies for health service delivery in Tuvalu.
Deliverable 1.2: Preparation of Options Papers for the review and amendment of the Public Health Act in Tuvalu.
Deliverable 1.3: Support development of knowledge products and tools for countries undertaking amendment and review of health system legislation.  In particular, a guide to the use of legislation to regulate medicines and medical products in the Pacific.

Qualifications, experience, skills and languages

Educational Qualifications

Essential: Bachelor of Laws
Desirable: Post-graduate qualification in public policy and/or public health an advantage.

Experience

Essential: Minimum 7 years’ relevant experience in law and policy
Desirable: Experience in development of health sector legislation an advantage. Relevant experience in developing country is also an advantage.

Skills/Knowledge

Essential: Experience in legal research and developing legislative proposals is desirable.
Desirable: Experience working in the health sector is desirable.

Languages and level required

Expert in written and spoken English

Location

The consultant will work off-site.

Travel

While the place of assignment is home-based, the Consultant will be requested to undertake travel as part of the engagement.

Remuneration and budget

Remuneration: Pay band level C, USD 500 (daily)
Duration of contract: 5 months, 5 August to 31 December 2024 (2 days/week)
