Description of the Assignment:
Objective:
The overall objective of this consultancy is to provide technical support and inputs and conduct an assessment of the entire case management process of the Lao courts, both criminal and civil case management with the aim of enhancing the court system’s effectiveness and accountability, particularly in the management of criminal and civil cases.
Scope of Work
The National Consultant will work with the project team, project associate, project coordinator/manager of the Court Project under the supervision of the UNDP Governance Team Leader and/or UNDP programme staff, and closely with the International Consultant under the same assignment. The consultant will be responsible for:
1. Support conducting an assessment to map out the case management process and identify gaps against international best practices and advise international consultant on local context.
2. Support conducting consultations with criminal, civil, and relevant Chambers, judges, court officers at all court levels (central and local), prosecutors, police, lawyers, and other stakeholders that are relevant to the expected outcomes of the assignment.
3. Support researching international best practices.
4. Support drafting the final findings report and help to ensure those findings are in an action plan aligned with the project results framework, project goals, and stakeholders’ expectations, especially considering the local context.
The consultant is expected to work closely with the PSC, regional and provincial courts, the relevant partners from the justice sector, in particular the international consultant and other relevant sectors to ensure that this consultancy delivers good outcomes. The National Consultant will play a crucial role in the assessment and planning phase of the project by leveraging their local expertise, knowledge of the Lao judicial system, and relationships with stakeholders. Working closely with the International Consultant, they will ensure that global best practices are adapted to the specific needs and challenges of Lao PDR. The National Consultant will assist in mapping current case management processes, facilitating consultations with key stakeholders—including judges, court officers, prosecutors, and marginalized groups—and gathering localized data to inform the assessment. They will contribute to the analysis of consultation results and provide input on findings, ensuring that the recommendations are both practical and aligned with local realities. In collaboration with the International Consultant, the National Consultant will help develop a SMART action plan that balances international standards with local needs, ensuring that the project’s recommendations are feasible, culturally appropriate, and address stakeholder priorities effectively.
The tasks of the National Consultant will include:
Task 1 (10 days): Support the assessment to map out the case management process and identify gaps against international best practices management process and identify gaps
· Assist in developing a reasoned methodology, inception note, and detailed and timely workplan on the assignment;
· Support the mapping of the case management chain by gathering relevant data and coordinating with local stakeholders, including linking to the existing UNDP initiative on the Standard Operating Procedures for the Justice Sector on GBV.
· Provide logistical and analytical support in identifying specific challenges at each step of the case management process that require improvements.
Task 2 (2.5 days): Facilitate stakeholder consultations and provide logistical support.
· Organize and coordinate a series of consultancies with criminal, civil, and relevant Chambers, judges, court officers at all court levels (central and local levels), prosecutors, police and lawyers, and other stakeholders that are relevant to the expected outcomes of the assignment;
· Provide on-the-ground support during consultations, ensuring smooth facilitation and effective stakeholder engagement.
· Document and summarize the consultation outcomes, including stakeholder needs and expectations, and submit these for the International Consultant’s analysis. Contribute to the pieces of advice to all outputs of this consultancy.
Task 3 (2.5 days): Provide localized insights to supplement desk research conducted by the international consultant.
· Assist the International Consultant in gathering localized data and contextual information to inform desk research on best international practices in case management.
· Provide contextual insights and ensure that global recommendations are adaptable to the specific realities of Lao PDR.
· Review and validate findings from the desk research to ensure they align with local judicial needs.
Task 4 (5 days): Support the development of the action plan aligned with the project results framework, project goals and stakeholders’ expectations.
· Support in combining the findings report and desk research into a final report that outlines the key case management gaps in the Lao PDR and includes a SMART action plan (Recommendations on tools, SOPs, templates or system) to fill those gaps in alignment with the applicable project results framework; Provide input to ensure that the SMART action plan reflects local stakeholder priorities and practical implementation considerations.
Assist on a concrete roadmap for implementing the activities outlined in the results framework ensuring alignment with project goals and stakeholder expectations, coordinating with local stakeholders as required.
