Responsibilities: 

Under the oversight of the General Counsel and Director of the Legal Department and the direct supervision of the Head and Deputy Head(s) of LEGFF and with the assistance of a backstopper, the regional advisor’s responsibilities will include the following:

  • Providing, managing, and coordinating CD and CD advisory services to Fund member countries in the area of fiscal law with specific focus on PDM legal frameworks; the resident advisor’s CD work will cover a variety of legal topics, including the scope of public debt, legal authority to borrow, institutional responsibilities, borrowing purposes, debt-related contingent liabilities, and reporting and monitoring. The Regional Advisor’s activities will include:
  • Drafting, advising, and reviewing existing and/or draft PDM legal frameworks, including laws (primary legislation) and regulations (secondary legislation) and providing recommendations and drafting suggestions, and conducting any related research work;
  • Organizing, leading and/or participating in field-based and/or remote TA missions (either alone, with headquarters-based staff, or short-term experts (STX)) and other CD activities, such as training, regional workshops, and peer to peer events, on PDM legal framework and related areas, such as legal underpinnings for contractual aspects, including managing and carrying out pre- and post- mission work;
  • Coordinating advisory work on PDM legal frameworks in the countries covered by the resident advisor’s activities, implemented through short-term experts as needed;
  • Providing input as needed to the work of STXs, to assist in ensuring that advice is tailored to the particularities of the CD recipients with whom the resident advisor is expected to gain more familiarity;
  • Preparing required documents prior to and after each mission for internal review and approval and ensuring transmission of final documents to member country authorities;
  • Preparing and reviewing regular reports for pertinent headquarter-based staff on ongoing activities;
  • Liaising, as applicable, with Fund resident advisors, technical assistance centers coordinators, and resident representatives in member countries on PDM legal issues;
  • Liaising and coordinating on relevant projects with other CD providers working in member countries, as well as with other IMF CD departments, as necessary; and
  • Carrying out other assignments as instructed by the LEGFF management.

The regional advisor will strictly observe the Code of Conduct included in the Long-Term Expert Handbook of the Fund and exercise utmost discretion and confidentiality regarding all matters of official business.

Requirements:

Candidates will have a relevant academic background, including an advanced university degree in law or its equivalent. A minimum of 4 years, with a strong preference for 8 or more years of relevant professional experience with direct involvement in issues of fiscal law is also required, including in a senior line or advisory position within a ministry of finance, international financial institution, development partner, or the private sector working and advising on legal and regulatory issues related to PDM, and other broader PFM issues. The successful candidate will have also reviewed and/or drafted legislations or regulations in PDM.

The successful candidate will have to demonstrate strong analytical and time management skills, initiative and adaptability, effective written and oral communication skills, sound legal judgment, excellent planning and organizational skills with a capacity to lead or coordinate projects, and a strong ability to maintain effective and cooperative relations with country counterparts at all levels and of different cultural backgrounds, and with other international organizations, donors and stakeholders. Experience in delivering capacity development support in low- and middle-income countries, including organizing and conducting training courses and workshops, is highly desirable. Additional proficiency in languages other than English would be a plus.

In applying for this assignment, candidates should be prepared to reside in Ebene, Mauritius and travel frequently to countries receiving CD advice, including Fund-supported program countries and fragile states, primarily, but not limited to, the Sub-Saharan Africa and Middle East and North Africa regions. Close proactive cooperation with colleagues in Washington DC, as well as occasional travel to IMF headquarters will also be required.

The advisor is expected to be appointed for an initial period of 1 year (contractual appointment), with possible extensions dependent upon availability of funding, continued business needs, demand and satisfactory performance.

They will work under the general administrative direction of the Director of AFS/ATI, while on technical and substantive issues, he/she will report to LEG staff at IMF Headquarters.
