Purpose of consultancy

The general purpose of this consultancy is to support the Health Law and Ethics Unit in assisting Member States of the Western Pacific to strengthen legal frameworks towards achieving health in the Sustainable Development Goals. Specifically, the consultant will provide technical support on drafting of health legislation, and related support as required.

Background

The Western Pacific Regional Action Agenda on Strengthening Legal Frameworks for Health in the Sustainable Development was endorsed by Member States at the 69thsession of the Regional Committee for the Western Pacific (RC69) in October 2020. The action agenda provides guidance to countries on prioritising action areas, improving processes, and enhancing capacities of stakeholders. Direct support to countries on the strengthening of legal frameworks for health is a key priority for the Health Law and Ethics Unit (HLE).

As part of these efforts, HLE is supporting countries to review and strengthen their legal frameworks for health emergencies and managing public health risks in light of the COVID-19 pandemic. The experience has revealed that legal frameworks in many countries require strengthening to enable an effective, coordinated, and balanced response to a long-term, wide-scale emergency such as COVID-19, as well as manage more routine risks to public health and address emerging public health challenges. As countries examine their public health laws, some are also identifying opportunities to address challenges in other health legislation, including those relating to health services. In some countries, domestic legislative drafting capacity is not able to provide the drafting services required to meet the government’s legislative reform agenda.

HLE is supporting Vanuatu, Solomon Islands and PNG to review public health laws and health administration laws.  Other countries have indicated interest and may also be provided technical assistance.

WHO has been requested to assist in drafting a Health Services Bill for Solomon Islands and the Public health Bill and the Health Committees Bill for Vanuatu.

Deliverables

The selected Consultant will work under the supervision of the Coordinator for Health Law and Ethics Unit and will support the following activities:

  • Contribute to technical support on the finalization of a Health Services Bill for Solomon Islands and a Public health Bill and Health Committees Bill for Vanuatu, including addressing stakeholder input provided in consultation.
  • Contribute to technical support on the development of materials for parliament and in support of implementation.

Output 1: Technical support for legislative drafting.

Deliverable 1.1: Prepare Bills, based on drafting instructions prepared by WHO and endorsed by the Ministry of Health and in coordination with other stakeholders such as Attorney Generals Department.
Deliverable 1.2: Attend meetings and briefings as necessary.
Deliverable 1.3: Provide technical support on legislative drafting activities in other areas.

Qualifications, experience, skills and languages

Educational Qualifications

Essential: Master of Laws (LLM)
Desirable: Post-graduate qualification in public policy and/or public health an advantage.

Experience

Essential: Minimum 11 years’ relevant experience in legislative drafting, including primary legislation, in a common law jurisdiction.
Desirable: Experience drafting legislation in the Pacific is highly desirable.

Skills/Knowledge

Essential: Ability to draft high quality and plain language legislation.
Ability to work with and build the capacity of other legislative drafters.

Expert in written and spoken English

While the place of assignment is home-based, the Consultant will be requested to undertake travel as part of the engagement.

Remuneration and budget (travel costs excluded)

Remuneration: Payband level C – USD 600 (daily)
Duration of contract : 1 August to 31 December 2024 (5 months, 3 days/week)
