JOB DESCRIPTION

Org. Setting and Reporting

This position is located in the Support and Sharing Section (SSS) of the International, Impartial and Independent Mechanism to assist in the investigation and prosecution of persons responsible for the most serious crimes under International Law committed in the Syrian Arab Republic since March 2011 (IIIM). SSS coordinates cooperation agreement negotiations and immediate support to competent jurisdictions through the facilitation of ongoing investigations and prosecutions. The incumbent will be under the overall supervision of the SSS Senior Legal Officer and under the direct supervision of a P-4-Investigator.

The incumbent will be responsible for planning and conducting investigative activities as part of a multi-disciplinary team of legal officers and analysts charged with providing immediate support to ongoing investigations and prosecutions by competent jurisdictions in response to requests for assistance.

Responsibilities

Within delegated authority, the Investigator will be responsible for the following duties: – Undertakes investigations in cases involving serious breaches of international humanitarian law, such as genocide, crimes against humanity, war crimes, rape and sexual and gender- based violence, including undertaking field missions, when required.

– Identifies, engages and manages relationships with a diverse range of sources, including intermediary NGOs.

Assists with engagement with requesting judicial authorities. – Obtains statements from survivors and vulnerable victims, including in difficult or hostile environments and circumstances, and through the use of interpreters. Conducts interviews with other types of witnesses relevant to the investigation. – Reviews and analyzes documentary evidence, assesses relevance for sharing with competent jurisdictions and determines information necessary for inclusion in interviews.

– Participates in briefings, presentations, and conferences with investigations staff, other members of the IIIM, as well as actors external to the IIIM, including governmental officials, civil society actors, UN entities and other partners relevant to the collection of information and evidence.

– Searches for, identifies, collects, records and preserves physical evidence ensuring that all potential or relevant evidence is gathered and secured, and that all necessary evidential chains of custody are established and maintained.

Assists in the presentation of evidence in proceedings, if required. – Prepares complete and concise investigation reports, briefs and files, incorporating as necessary maps, graphs, charts, tables, images and other illustrative devices. – Prepares thorough mission plans and reports. – Conducts open-source research.

Searches and registers sources, evidence, data, and information in evidence management databases. – Conducts additional inquiries requested of, or by IIIM. – Performs administrative functions pertaining to the implementation of policies and procedures for the IIIM.

– Assists in forensic projects when required. – Attends court and gives in-court testimonial evidence when required.

Education

An advanced university degree (Master’s degree or equivalent degree) in law, international law, criminology, criminal justice, criminal investigations, police studies, human rights, political/social science or a related field is required.

A first-level university degree in combination with two additional years of qualifying work experience may be accepted in lieu of the advanced university degree.

Work Experience

A minimum of five years of progressively responsible work experience in law enforcement, criminal investigations or other related types of investigations involving serious breaches of international humanitarian law, such as genocide, crimes against humanity, war crimes, rape and sexual and gender-based violence or related legal area is required.

Experience as an investigator with domestic law enforcement authorities or an international criminal justice mechanism is desirable.

Experience interviewing witnesses and victims of crimes for criminal justice purposes is desirable. Experience collecting evidence, including from open sources, in the area of international crimes relating to events in the Middle East for criminal justice purposes is desirable. Experience analyzing complex and diverse forms of evidence using an electronic evidence review platform is desirable. Experience managing relationships with intermediaries in investigative contexts and remote/restrictive environments for criminal justice purposes is desirable.

Experience in the planning and safe conduct of operations to gather evidence in challenging or hostile environments for criminal justice purposes is desirable.

Experience in the preparation of investigation reports and other investigation related documentation for criminal justice purposes is desirable. Experience giving evidence in court for criminal justice purposes is desirable.

Languages
English and French are the working languages of the United Nations Secretariat. For the position advertised, fluency in English is required. Knowledge of Arabic is desirable.

• This Temporary Job Opening is intended to fill the functions of short- term duration for 364 days (with possibility of extension), with an estimated start date as soon as possible.

In the case of separation from service on retirement, a former staff member will be ineligible for re-employment for a period of three months following the separation. This equally applies, mutatis mutandis, with respect to a former or current staff member who has held or holds an appointment in another entity applying the United Nations Staff Regulations and Rules and who applies for a temporary position with the Secretariat.

• A current staff member who holds a fixed-term, permanent or continuing appointment may apply for temporary positions no more than one level above his or her current grade.

However, a current staff member who holds an appointment at the G-6 or G-7 level may also apply to temporary positions in the Professional category up to and including the P-3 level, subject to meeting all eligibility and other requirements for the position. • A staff member holding a temporary appointment shall be regarded as an external candidate when applying for other positions, and may apply for other temporary positions at any level, subject to section 5.7 below and staff rule 4.16 (b) (ii).

Therefore, a staff member holding a temporary appointment in the General Service or related categories may only apply to positions within those categories.

In its resolution 66/234, the General Assembly further “stressed that the Secretary-General should not recur to the practice of temporarily filling posts in the Professional and higher categories with General Service staff members who have not passed the General Service to Professional category examination other than on an exceptional basis, and requests the Secretary-General to ensure that temporary occupation of such posts by the General Service staff shall not exceed a period of one year, effective 1 January 2013…” Consequently, eligible candidates in the General Service or related categories for temporary job openings in the Professional category that have not passed the competitive examination may be selected only on an exceptional basis endorsed by the Office of Human Resources Management where no other suitable candidate could be identified.

• While this temporary assignment may provide the successful applicant with an opportunity to gain new work experience, the selection for this position is for a limited period and has no bearing on the future incumbency of the post.

An external candidate selected for this position is bound by the prevailing condition of the staff selection system under ST/AI/2010/3, as amended, and ST/AI/2010/4/Rev.1. A staff member holding a temporary appointment who is recruited in the Professional and above categories on a temporary appointment and placed on a position authorized for one year or longer may not apply for or be reappointed to his/her current position within six months of the end of his/her current service.

This provision does not apply to staff members holding temporary appointments and placed on positions authorized for one year or more in duty stations authorized for peacekeeping operations or special political missions.
